David Josiah Brewer was born on June 20, 1837 in Turkey. He was the son of Emilia Field Brewer and Reverend Josiah Brewer. Brewer's family moved to the United States when he was still a young boy, eventually settling in Connecticut. He attended Yale University, where he graduated in 1856.
After graduating from Yale, Brewer studied law and was admitted to the bar in 1858. He practiced law in Kansas for several years before being appointed a judge of the probate court.
